Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the Clear Choice Cleaning Services website (the “Service”) operated by Clear Choice Cleaning Services (“us”, “we”, or “our”).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. SERVICES
Clear Choice Cleaning Services provides professional cleaning services including, but not limited to, commercial cleaning, post-construction cleaning, and move-in/move-out cleaning services throughout Manhattan, Queens, Bronx, Staten Island, Brooklyn, Nassau County, and Suffolk County.
All services are subject to availability and confirmation. We reserve the right to refuse service to anyone for any reason at any time.
2. SCHEDULING AND APPOINTMENTS
2.1 Booking: Appointments may be scheduled online, via telephone, or email. We recommend scheduling services at least 48-72 hours in advance to ensure availability.
2.2 Confirmation: All appointments are subject to confirmation by Clear Choice Cleaning Services. You will receive confirmation via email or telephone.
2.3 Access: Client must provide Clear Choice Cleaning Services with access to the premises at the scheduled time. Failure to provide access may result in cancellation fees.
3. CANCELLATION AND RESCHEDULING POLICY
3.1 Client Cancellations: Cancellations must be made at least 24 hours prior to the scheduled appointment time. Cancellations made with less than 24 hours’ notice may be subject to a cancellation fee of up to 50% of the scheduled service cost.
3.2 Rescheduling: Requests to reschedule must be made at least 24 hours in advance. We will make reasonable efforts to accommodate rescheduling requests based on availability.
3.3 Company Cancellations: Clear Choice Cleaning Services reserves the right to cancel or reschedule appointments due to emergencies, inclement weather, or other unforeseen circumstances. Clients will be notified as soon as possible.
4. PRICING AND PAYMENT
4.1 Pricing: Pricing is based on the scope of work, square footage, and specific services requested. All quotes are estimates and may be adjusted based on actual conditions encountered.
4.2 Payment Terms: Payment is due upon completion of services unless otherwise agreed upon in writing. We accept major credit cards, debit cards, checks, and electronic payments.
4.3 Late Payments: Accounts not paid within 30 days of invoice date may be subject to a late fee of 1.5% per month (18% annually) or the maximum rate permitted by New York State law, whichever is less.
4.4 Deposits: For large projects or first-time clients, a deposit of up to 50% may be required to secure the appointment.
5. CLIENT RESPONSIBILITIES
5.1 Preparation: Client agrees to prepare the premises by removing valuable, fragile, or personal items prior to service.
5.2 Disclosure: Client must disclose any hazardous materials, special conditions, or areas requiring special attention prior to service.
5.3 Pets: Client must secure pets in a safe location away from the cleaning area during service.
5.4 Utilities: Client must ensure that water, electricity, and heating/cooling systems are operational during service.
6. LIABILITY AND INSURANCE
6.1 Insurance: Clear Choice Cleaning Services maintains general liability insurance and workers’ compensation insurance as required by New York State law.
6.2 Limitation of Liability: Our liability is limited to the cost of the service provided. We are not liable for:
• Pre-existing damage or conditions
• Damage resulting from client’s failure to disclose special conditions
• Damage to items that should have been removed prior to cleaning
• Consequential or indirect damages
6.3 Claims: Any claims for damage must be reported within 24 hours of service completion. Failure to report within this timeframe may result in denial of the claim.
6.4 Force Majeure: We are not liable for failure to perform services due to circumstances beyond our control, including but not limited to acts of God, natural disasters, strikes, or government restrictions.
7. SATISFACTION GUARANTEE
We are committed to your satisfaction. If you are not completely satisfied with our service, please contact us within 24 hours of service completion. We will arrange to return and re-clean the areas of concern at no additional charge. This guarantee applies only to the initial service and does not extend to subsequent re-cleans.
8. CONFIDENTIALITY AND PRIVACY
We respect your privacy and maintain the confidentiality of all client information. Our employees are trained to maintain professional standards and discretion. We do not share client information with third parties except as required by law.
9. INTELLECTUAL PROPERTY
The Service and its original content, features, and functionality are and will remain the exclusive property of Clear Choice Cleaning Services. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
10. TERMINATION
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Clear Choice Cleaning Services, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right; or (iv) any claim that your use of the Service caused damage to a third party.
12. DISPUTE RESOLUTION
12.1 Governing Law: These Terms shall be governed and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.
12.2 Jurisdiction: Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in New York, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
12.3 Mediation: In the event of a dispute, both parties agree to attempt to resolve the matter through good faith negotiation or mediation before pursuing litigation.
13. DISCLAIMER OF WARRANTIES
Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Clear Choice Cleaning Services does not warrant that (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.
14. SEVERABILITY
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
15. WAIVER
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
16. ENTIRE AGREEMENT
These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.
17. CHANGES TO TERMS
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
